OVERVIEW

Welcome to IMAGINAT! The terms "we", "us" and "our" refer to IMAGINAT. IMAGINAT operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). IMAGINAT is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You represent and warrant that all the information you provide in our stores is correct, current and complete. You are solely responsible for maintaining the security of your account credentials.

SECTION 2 - PRODUCT CHARACTERISTICS & ARTISTIC INTERPRETATION

2.1 Material Nature: Our figurines are manufactured using SQ-2A Rigid Resin [Image 2]. You acknowledge that this material is professional-grade but brittle and intended for display purposes only. It is not a toy and is not suitable for children. IMAGINAT is not liable for damage caused by handling, dropping, or improper display.

2.2 Color & Finish: We capture 500,000+ colors [Image 1]. However, physical resin colors may differ from the digital renders on your screen due to device settings. For models sized $15\text{ cm}$ or $20\text{ cm}$ , horizontal printing is used, which results in a unique dual-finish (Glossy/Matte) on opposite sides of the figurine.

2.3 Subjectivity of AI Likeness: For Signature Replicas and DreamScapes, our AI pipeline interprets your 2D photos to create a 3D model [Image 1]. While we aim for over 90% likeness, the final product is an artistic interpretation. By approving the Digital Proof, you accept this interpretation as final.

SECTION 3 - CUSTOM COMMISSIONS & CANCELLATIONS

3.1 Personalized Goods: In accordance with EU and Spanish consumer law (Art. 103 TRLGDCU), the right of withdrawal (14-day cooling-off period) does not apply to goods made to your specifications or clearly personalized.

3.2 Production Start: Once you approve the Digital Proof, the order is sent to the printer and cannot be canceled, modified, or refunded.

SECTION 4 - PRICES AND BILLING

Prices for our Services are subject to change without notice. Unless otherwise stated, posted prices for customers in the European Union include VAT. For international orders, you are responsible for any local customs, duties, or import taxes.

SECTION 5 - SHIPPING AND DELIVERY

Estimates of delivery (typically 7–10 days) are not guaranteed. In accordance with Spanish law, risk of loss or damage to the products passes to you only when you, or a third party indicated by you, acquires physical possession of the goods.

SECTION 6 - INTELLECTUAL PROPERTY & CONTENT SUBMISSION

6.1 Your Content: By uploading photos for a Signature Replica or DreamScape, you represent that you own the rights to said images. You grant IMAGINAT a non-exclusive, royalty-free license to use, modify, and process these images solely for the purpose of fulfilling your order.

6.2 Prohibited Content: You may not use our Services to create figurines that infringe on third-party trademarks (e.g., Disney/Marvel characters without a license) or contain illegal, offensive, or defamatory material.

6.3 AI Assets: Digital 3D models created during the DreamScape process remain the intellectual property of IMAGINAT unless a "Digital Add-on" license is purchased separately.

SECTION 7 - RELATIONSHIP WITH SHOPIFY

IMAGINAT is powered by Shopify. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and IMAGINAT, including any injury or damage resulting from purchased products.

SECTION 8 - STATUTORY GUARANTEES (SPAIN/EU)

8.1 Conformity: For non-customized "Curated Gallery" items, we provide a statutory 3-year legal guarantee from the date of delivery for any lack of conformity.

8.2 Claims: To report a defect or damage, you must contact hola@imaginat.studio within 7 days of receipt with photographic evidence.

SECTION 9 - GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Spain. You and IMAGINAT agree that any disputes will be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
